1. Acceptance of Terms
By creating an account or using JobSucks ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.
2. Eligibility
You must be at least 18 years old and legally able to enter into binding contracts. By using the Platform, you represent that you meet these requirements.
3. Account Types & Responsibilities
3.1 Business Accounts
- You may post jobs, review bids, hire freelancers, and manage projects
- You are responsible for providing clear and accurate job descriptions
- You agree to pay freelancers promptly upon satisfactory completion of work
- Job postings must not contain discriminatory, illegal, or misleading content
3.2 Freelancer Accounts
- You may browse jobs, submit bids, communicate with businesses, and deliver work
- You are responsible for the quality and timeliness of your deliverables
- Your profile information, skills, and portfolio must be accurate and truthful
- You operate as an independent contractor, not an employee of JobSucks
4. Platform Rules
All users agree to:
- Maintain the confidentiality of their account credentials
- Not create multiple accounts for deceptive purposes
- Not engage in spam, harassment, or abusive behavior
- Not use the Platform for illegal activities or to post prohibited content
- Not circumvent the Platform's payment or communication systems
- Comply with all applicable laws and regulations
5. Bidding & Hiring
Submitting a bid is a non-binding expression of interest. A binding agreement is formed only when a business accepts a freelancer's bid. Both parties are then expected to fulfill their obligations as described in the job posting and bid proposal.
6. Payments & Fees
- All monetary values are displayed in USD by default, with optional currency conversion
- JobSucks may charge service fees on completed transactions
- Payment terms are agreed upon between the business and freelancer
- JobSucks is not responsible for payment disputes between users
7. Intellectual Property
Unless otherwise agreed in writing, intellectual property rights for work delivered through the Platform transfer to the business upon full payment. Freelancers retain the right to showcase completed work in their portfolios unless the business explicitly restricts this.
8. Reviews & Ratings
Users may leave honest reviews after project completion. Reviews must be truthful, relevant, and non-defamatory. JobSucks reserves the right to remove reviews that violate these guidelines.
9. Dispute Resolution
In case of disputes between users, we encourage direct communication first. If resolution cannot be reached, JobSucks may offer mediation services at our discretion. Our decisions in dispute cases are final.
10. Limitation of Liability
JobSucks provides a marketplace platform and does not guarantee the quality of work, the solvency of users, or the outcome of any transaction. We are not liable for:
- Disputes between businesses and freelancers
- Loss of data, revenue, or business opportunities
- Content posted by users on the Platform
- Service interruptions beyond our reasonable control
11. Account Suspension & Termination
We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or harm the Platform community. Users may delete their accounts at any time through their profile settings.
12. Modifications
We may modify these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the revised Terms. Material changes will be communicated via email or platform notification.
